4. Apple tree rental contract terms
1. Parties
The parties to the agreement are AppleBros, business-ID: 3435156-2, and the lessee of the apple tree who accepted this agreement and paid the rent.
2. Object of the contract
The subject of the contract is one or more apple trees rented from the AppleBros farm for the duration of the rental period in question. The duration of the rental period is indicated in the order confirmation. A rented apple tree means an apple tree cultivated by AppleBros, which is marked as the tenant's apple tree when paying the rent. The expected yield of rented apple trees is about 5-14 kg per apple tree. The yield of the leased apple tree is transferred in its entirety to the tenant of the apple tree after he has paid the rental fee according to this contract. Cultivation involves cultivation risks that can affect the amount of the harvest. Such risks include winter damage to trees, mole damage, deer damage, frost during flowering or other extreme weather conditions during the harvest season. The expected value of the yield is based on a production calculation of how the yield of dense apple planting develops when the cultivation is done properly.
3. AppleBros' rights and obligations
AppleBros maintains and protects their apple orchard to the best of their ability to ensure a good harvest and customer satisfaction for tree renters. This includes e.g. pruning of apple trees, thinning of raw sap, plant protection, informing apple tree renters, mowing the grass between rows, observing the condition of apple trees, replacing possibly damaged and dead apple trees with new ones, maintaining the condition of the fence and supporting the trees.
AppleBros always informs about apple harvest pickups via e-mail or other private communication.
AppleBros will notify by email the time of harvest and the deadline within which the harvest can be collected from the farm. The apples must be picked up within a week from the picking point. After the deadline, AppleBros is not obliged to store the harvest on behalf of the tenant of the apple tree, but the right to harvest the rented tree without separate compensation is transferred to AppleBros.
4. The rights and obligations of the lessee of the apple tree
The tenant of the apple tree must pay the rent of the tree, which is determined according to the object of the contract. In this contract, the rent for one tree is defined as at least 60 euros (including VAT 14%). The contract and price are always valid for one crop year at a time. You can rent an apple tree all year round in the online store whenever free apple trees are available.
The tenant of the apple tree must pick up his crop within the specified time in connection with the harvest. The renter of apple tree must notify AppleBros of any changes to their contact information. Changes must be reported by email to asiakaspalvelu@applebros.fi
If necessary, the lessee of the apple tree can, according to a separate agreement, visit the apple farm, other than in connection with harvesting and collection and other possible joint meetings, but visiting the farm and the apple orchard without an agreement is prohibited. The apple tree renter must take into account the cultivation risk associated with renting an apple tree and that the actual yield may vary between years.
